Common use of Recapture Clause in Contracts

Recapture. Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ receives any payment or payments on account of the liabilities guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇, the undersigned’s obligations to ▇▇▇▇▇▇ shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to Laurus, which payment shall be due on demand.

Recapture. Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ receives any payment or payments on account of the liabilities guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇, the undersigned’s 's obligations to ▇▇▇▇▇▇ shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to Laurus, which payment shall be due on demand.

Recapture. Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ any Creditor Party receives any payment or payments on account of the liabilities guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇the Creditor Parties, the undersigned’s obligations to ▇▇▇▇▇▇ the Creditor Parties shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to Laurusthe Creditor Parties, which payment shall be due on demand.

Recapture. Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ any Purchaser receives any payment or payments on account of the liabilities guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇such Purchaser, the undersigned’s obligations to ▇▇▇▇▇▇ such Purchaser shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to Laurussuch Purchaser, which payment shall be due on demand.

Recapture. Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ Laurus receives any payment or payments on account of the liabilities guaranteed liabiliti▇▇ ▇▇▇ranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇Laurus, the undersigned’s 's obligations to ▇▇▇Laurus shall be reinstated ▇▇▇ shall be reinstated and this ▇his Guaranty shall remain in full force and f▇▇▇▇ ▇nd effect (or be reinstated) until payment shall have been made to Laurus, which payment shall be due on demand.

Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ Buyer receives any payment or payments on account of the liabilities Obligations guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party Person under any Insolvency Lawbankruptcy law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇Buyer, the undersignedGuarantor’s obligations to ▇▇▇▇▇▇ Buyer shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to LaurusBuyer, which payment shall be due on demand.

Anything in this Guaranty to the contrary notwithstanding, if ▇▇▇▇▇▇ NFB receives any payment or payments on account of the liabilities guaranteed hereby, which payment or payments or any part thereof are subsequently invalidated, declared to be fraudulent or preferential, set aside and/or required to be repaid to a trustee, receiver, or any other party under any Insolvency Law, common law or equitable doctrine, then to the extent of any sum not finally retained by ▇▇▇▇▇▇NFB, the undersigned’s Guarantor's obligations to ▇▇▇▇▇▇ NFB shall be reinstated and this Guaranty shall remain in full force and effect (or be reinstated) until payment shall have been made to LaurusNFB, which payment shall be due on demand.
