RECEIVER AND OTHER REMEDIES. If an Event of Default shall have occurred and, during the continuance thereof, Collateral Agent shall have commenced judicial proceedings to enforce any right under this Deed of Trust, then Collateral Agent shall, to the extent permitted by law, be entitled, as against Grantor, to the appointment of a receiver of the Mortgaged Property and subject to the rights, if any, of others to receive collections from former, present or future customers of the rents, issues, profits, revenues and other income thereof, and whether or not any receiver is appointed, Collateral Agent shall be entitled to retain possession and control of, and to collect and receive the income from cash, securities and other personal property held by Collateral Agent hereunder and to all other remedies available to mortgagees and secured parties under the UCC or any other applicable law.
