Common use of Recision Clause in Contracts

Recision. The agency shop provision in this MOU may be rescinded by a simple majority of votes cast by eligible bargaining unit members, provided that: 1. A request for such vote is supported by a petition containing the signatures of at least 30 percent of the employees in the unit. 2. The vote is by secret ballot. 3. The vote may be taken at any time during the term of the MOU, but in no event shall there be more than one vote taken during that term. Notwithstanding the above, the City and the Union may negotiate, and by mutual agreement provide for, an alternative procedure or procedures regarding a vote on an agency shop agreement. 4. If a “recision vote” is approved by unit members during the term of this MOU, the Union agrees not to petition for or seek Agency Shop status for the remainder of the MOU.
