The District is a special district organized under Colorado law and which provides treated water service to its customers for which monthly service charges are made. RECITALS AND PURPOSE. 2.1 The TOWN is the owner of certain property known as , located in the Town of Lyons, Boulder County, Colorado, having acquired the property, which was substantially damaged in the flood of September 2013, through a federally funded buyout program after the previous owner of the property elected to accept a buyout rather than attempting to redevelop the property (the “Licensed Premises”). Title to the Licensed Premises passed to the Town following the buyout, and the Town is now generally precluded from building any improvements or otherwise developing the Licensed Premises for anything other than passive recreational uses. The Licensed Premises is more particularly described/depicted/identified on the attached Exhibit A.
2.2 The LICENSEE is the owner of property commonly known and addressed as (“Licensee’s Property”) and maintains an existing private residential structure on the Licensee’s Property. The Licensee desires to use and occupy the adjacent Licensed Premises for passive uses that are customarily incidental to the primary residential use of the Licensee’s Property.
2.3 The TOWN believes that the passive use by the Licensee of the Licensed Premises for uses that are consistent and compatible with the primary residential use, subject to the limitations stated herein, would be in the best interests of the community, would not impair vehicle or pedestrian access to Town-owned park land in the area, and would not affect the integrity of existing utilities located on or under the Licensed Premises.
2.4 The TOWN is willing to grant a revocable license to the Licensee under the terms and conditions as specified herein, provided that noting in this Agreement shall authorize any use the Town would not be permitted to maintain on the Licensed Premises.
