RECOGNITION AND JURISDICTION. The Employer recognizes the Union as the sole bargaining agent for all of the Employer’s meat department employees in its retail stores located in the Ohio Counties of Ashtabula, Cuyahoga, Geauga, Lake, Lorain, and Medina, and, as covered be the Addendum hereto, the Ohio Counties of Ashland, Erie, ▇▇▇▇▇▇, Huron, Portage, ▇▇▇▇▇, Summit, Tuscarawas, and ▇▇▇▇▇, and the Pennsylvania County of Erie, excluding super­ visors (as defined in the National Labor Relations Act, as amended). Furthermore, the handling, processing, and offering for sale of fresh and frozen meats, poultry, fish, rabbits, ▇▇▇­ ▇▇▇▇, and smoked meat which has customarily been performed by bargaining unit employees in the store shall continue to be within the work and collective bargaining jurisdiction of the Union, regardless of place of performance, (1) to the extent such work continues to be performed by the Employer within the Union’s geographical area of representation as set forth above, and (2) to the extent such work is not currently per­ formed by employees who are represented by another union. Specifically, although only the Employer’s store meat depart­ ments in the aforementioned counties are covered by this Agreement, the Employer recognizes that the Union has work and collective bargaining jurisdiction over the Employer’s store delicatessen operations, store prepared and/or hot foods operations (including adjunct cafeterias), meat warehouses, and central cutting plants, when any such operations are located within the aforementioned counties and are not currently rep­ resented by another union. Provided, that . . . (1) The Employer shall retain managerial discretion i the areas of work methods and/or processes and merchandis­ ing policies and/or techniques, including, but not limited to, the rights to introduce new and/or change existing work methods and/or processes (centralized or de-centralized), to introduce new equipment and/or technological processes, and to obtain and sell pre-cut, pre-packaged, pre-processed, pre­ priced, etc., products from outside sources; (2) The Employer will notify the Union before making any major technological change that would affect a substan­ t ia l number o f employees; (3) No regular full-time employee will be displaced (i.e., deprived of a job), reduced in rate of pay, and/or reduced below regular full-time status (i.e., 40 hours per week) because of the exercise of such managerial discretion described in sub- paragraph 1 above. For the purpose o f this Article only, a regular full-time employee is one who, at the time of the change, has completed his probationary period and is actively working, is on an approved leave of absence, or is absent because of illness or injury; (4) If after the exercise of such managerial discretion described in subparagraph 1 above there are any unresolved questions concerning displacement, reduction in rate of pay, and/or reduction below full-time status, the Union may sub­ mit such questions to arbitration under the Grievance Pro­ cedure in this Agreement.

(b) Subject to Letter of fresh Understanding #1, “Severance Resulting from the Introduction of Counter Ready Meats”, the Employer agrees the following work shall be performed by employees of the Employer covered by this Collective Agreement, the receiving, cutting, grinding, preparing, processing, sealing, wrapping, bagging, pricing, fabricating, cubing, tenderizing, and frozen meats, poultryserving and selling of all meat, fish, rabbitsand poultry products whether fresh, ▇▇▇­ ▇▇▇▇frozen, and smoked meat which has customarily been chilled, cooked, cured, smoked, or packaged during the term of this Collective Agreement. However, it is also understood that the Employer shall not be precluded from making such decisions that pertain to the reassignment of work now being performed by bargaining unit employees covered by this Collective Agreement providing such reassignments will remain in the store shall continue jurisdiction of the Union and are handled in a manner that is mutually acceptable to be both parties to this Agreement during the term of this Collective Agreement. (a) If the Employer transfers work set forth in Article 2.1 to a meat plant operated by the Employer within the work and collective bargaining present area jurisdiction of the Union, regardless of place of performancethe Employer will recognize the Union as the bargaining agent for all employees, (1) to the extent such work continues to be performed excluding office and clerical staff and supervisory personnel, employed by the Employer within in said meat plant. Provided, that . . .cases: (1) The Employer shall retain managerial discretion i the areas of work methods and/or processes All delicatessen meats including: (a) Ready to eat prepared meats, poul­ try and merchandis­ ing policies and/or techniquesfish; (b) Sliced boiled, including, but not limited to, the rights to introduce new and/or change existing work methods and/or processes baked or barbecued ham; (centralized or de-centralized), to introduce new equipment and/or technological processes, and to obtain and sell pre-cut, pre-packaged, pre-processed, pre­ priced, etcc) Sliced packaged dried beef; (d) Smoked sausage; (e) Fresh pork sausage., products from outside sources; (2) The Employer will notify Frozen fresh poultry, fresh or iced poul­ try, cut-up or whole, processed on or off the Union before making any major technological change that would affect a substan­ t ia l number o f employeespremises; (3) No regular full-time employee will be displaced (i.e., deprived of a job), reduced in rate of pay, and/or reduced below regular full-time status (i.e., 40 hours per week) because of the exercise of such managerial discretion described in sub- paragraph 1 above. For the purpose o f this Article only, a regular full-time employee is one who, at the time of the change, has completed his probationary period and is actively working, is on an approved leave of absence, or is absent because of illness or injuryFrozen packaged fish; (4) If after Smoked butts, smoked ribs, smoked hocks and salt pork; (5) Frozen specialty meat items such as fro­ zen and formed (flaked or chopped) ▇▇▇­ ties and chopettes, with or without butter or vegetable, breaded or unbreaded. provided further that frozen fresh poultry, fresh and or iced poultry (cut-up or whole) processed on or off the exercise of such managerial discretion premises, fresh pork sausage and the frozen meat specialty items described in subparagraph 1 above there are any unresolved questions concerning displacement, reduction in rate of pay, and/or reduction below full-time status, priced or prepriced and fresh or iced poultry wrapped by meat de­ partment employees on the Union may sub­ mit such questions to arbitration under the Grievance Pro­ cedure in this Agreementpremises.
