Such duties 22 would include, but are not limited to, the ability to hire, transfer, suspend, layoff, 23 recall, promote, discharge, reward or discipline, adjust employment grievances, 24 independently evaluate other employees or otherwise responsibly direct other 25 employees with respect to their employment with the Hospital. The parties do not 26 consider routine monitoring, clinical guidance, providing written and/or oral input for 27 evaluation of other employees’ performance, peer evaluation, and professional 28 direction of employees to whom bargaining unit nurses delegate nursing tasks, 29 assigning professional responsibilities, preparing unit draft schedules, or performing

Registered Nurses shall 3 have sixty (60) calendar days in which to deliver to the Labor Representative and Ostomy Care Supervisor, RNFA, 4 the Bargaining Unit Chair by email correspondence or any other nurse who is a 16 Hospital from providing direct patient care. 18 The Hospital agrees by certified mail written 5 notice to the Association of their intention not to raise or challenge join. Notice must be 6 postmarked/sent within the non-supervisory status sixty (60) day period to be effective. A copy of 20 during the course of their employment. To be eligible for the religious exemption explained 7 above, the nurse must provide a letter to the Association, signed by a leader of employees 8 the church or religious body to which the nurse belongs stating: “Contributions to 9 organizations such as the Association are in conflict with tenets or teachings of 10 the church or religious body to which the nurse belongs.” 12 1.4 Any nurse who fails to comply with Article 1.2 shall, upon written notice from the 13 Association and confirmation by the Hospital that the nurse has had adequate 14 notice of and opportunity to correct the delinquency, be given fourteen (14) days’ 15 notice of termination or allowed to resign. 17 1.5 The Hospital will deduct Association membership dues from the salary of each 18 nurse who agrees to such deductions and who submits an appropriately signed 19 authorization form that is subsequently submitted to the hospital. Such 20 deductions shall be made once per month and be remitted to the Association 21 with a list of nurses from whom bargaining unit nurses delegate nursing tasks, 29 assigning professional responsibilities, preparing unit draft schedules, or performingthe deductions were made. Any changes in the 22 calculation of dues deducted under this section must be within the Saint 23 ▇▇▇▇▇▇▇▇▇’ existing payroll system.

The 4 Hospital’s notice to raise the Association will be provided at least thirty (30) 5 calendar days prior to posting the position. Upon request of the Association, 6 the parties will meet to determine if the position is properly excluded from the 7 bargaining unit using the criteria in Article 1.1 and the actual job duties of the 8 position in comparison with positions already in the bargaining unit. If the 9 parties are unable to reach consensus, then the Association may file a 10 grievance. Should an arbitrator find that the position properly belongs in the 11 bargaining unit, then the arbitrator will be authorized to require the Hospital to 12 pay the Association all outstanding dues. Failure of the Hospital to provide 13 appropriate notice will extend any timelines for the Association to request a 14 meeting and file a grievance. 16 1.3 Within thirty-one (31) days after employment or challenge within thirty-one (31) days 17 after the non-supervisory status execution date of 20 during this Agreement, whichever is the course later date, each 18 employee subject to this Agreement shall join and maintain membership in 19 the Association as a condition of their employment. The Hospital also agrees not to assign 21 supervisory duties to bargaining unit nurses on an ongoing basis. The Hospital shall not be obligated to remunerate the 4 representative for any time spent in orientation. 6 2.3 The Hospital will deduct Association membership dues, or fair share from 7 the salary of each nurse who voluntarily agrees to such deductions and who submits an 8 appropriately written authorization form to the Hospital setting forth standard amounts and 9 times of deduction. Deductions shall be made monthly and remitted to the Association 10 together with the names of those authorized deductions. The amount of dues to be 11 deducted shall be certified to the Hospital by the Association. 14 2.4.1 All registered nurses eligible for the bargaining unit shall, as a 15 condition of employment, within 31 days of employment or effective date of this 16 Agreement, whichever is later, become members of the Association or pay through 17 payroll deduction an amount certified by the Association per month as their "Fair 18 Share" of the cost of contract negotiations and Administration. 20 2.4.2 In order to safeguard the rights of nonassociation of nurses based 21 on bona fide religious tenants or teachings of a church or religious body of which a 22 nurse is a member, that nurse may exercise a choice of joining the Association or 23 paying an amount of money equivalent to regular Association dues to a 24 nonreligious charity mutually agreed upon by the nurse and the Association. 26 2.4.3 Within 30 days after the execution date of this Agreement, and 27 monthly thereafter, the Hospital shall provide the Association with a master list of 28 all employed nurses who are subject to the provisions of this Agreement, giving the 29 names, addresses, classification, date of birth, RN license numbers, and dates of
