Recommendation Procedures. 5.04.4.1 If after the application of Article 5.03.10 (Seniority Appointment Procedures) there are additional unstaffed courses, the Appropriate ▇▇▇▇ shall authorize an internal competition for these courses. Every internal advertisement shall state "St. ▇▇▇▇▇▇ University encourages applications from all qualified candidates and is committed to the principles of equity, diversity, and inclusion, including employment equity for the following under-represented groups identified in the Canadian Employment Equity Act: women, aboriginal persons, members of visible minority groups and persons with disabilities”. In addition, all internal advertisements shall include the St. ▇▇▇▇▇▇ University Indigenous Land Acknowledgement as found on the University website. Employees may apply for an additional course(s) and, if they meet the criteria specified in Article 5.01.1, they shall be considered qualified and shall be recommended. In the event that there are two (2) or more qualified Employees, the following process shall be applied: (i) Where two (2) or more qualified Employees apply for an additional course, the Employee with the most overall University seniority shall be offered the appointment. (ii) Where two (2) or more qualified Employees have the same overall University seniority, the initial hire date shall break the tie. (iii) Where two (2) or more qualified Employees have the same level of overall University seniority and have the same initial hire date, and one (1) of those Employees has self-identified as being a member of a group that is under-represented (Article 5. 02.1) then, all else being equal, the member of the under-represented group shall be offered the appointment. Whether a group is found to be under- represented shall be determined based on the data from the Employment Equity Report (Article 5.02.2). 5.04.4.2 After the application of Article 5.04.4.1, if there is an additional unstaffed course for which an Employee has seniority (Article 5.01.3) and that Employee is scheduled to teach eighteen (18) credit hours during the Teaching Year, and provided there is mutual agreement between the Employer and the Union [Articles 4.02.1 b) and d) (v)], then that course may be offered to that Employee in which case the requirement for an external competition under Article 5.04.4.3 shall be waived.

Every external advertisement shall state "St. ▇▇▇▇▇▇ University is committed to employment equity for women, aboriginal persons, members of visible minority groups and persons with disabilities”. 5.04.4.3 Before beginning its work, the Appropriate ▇▇▇▇ shall inform the PTAC that it must follow the Employment Equity provisions in the Agreement. Upon receipt of applications, the Department Chair shall arrange for the PTAC to consider all of the applications, following which an interview shall be waivedheld with one (1) or more candidates. Within fifteen (15) Days of the application deadline, and following majority approval by the PTAC, the Department Chair shall, in writing, propose a recommendation to the Appropriate ▇▇▇▇. The recommendation shall include evidence that the candidate meets the qualifications specified in the job advertisement and meets the criteria as established in Article 5.01. 1. The record of assessment in Appendix E may be used for the purpose of providing this evidence. (i) Where there are two (2) or more qualified external candidates and one (1) of those external candidates has self-identified as being a member of a group that is under-represented (Article 5. 02.1) then, all else being equal, the member of the under-represented group shall be offered the appointment. Whether a group is found to be under-represented shall be determined based on the data from the Employment Equity Report (Article 5.02.2). 5.04.4.4 The decision on appointments shall be made by the Appropriate ▇▇▇▇ who shall not unreasonably reject the recommendation by the Department. The Appropriate ▇▇▇▇ shall make the decision to accept or reject the Department’s recommendation within a reasonable period of time. If the Appropriate ▇▇▇▇ rejects the Department’s recommendation, she or he shall notify the Department Chair in writing with reasons, with a copy to the Member and the Union. The decision of the Appropriate ▇▇▇▇ shall not be subject to the arbitration procedures set out in this Agreement, unless the grievance to be submitted to arbitration is based on an alleged violation of Articles 2.04 (Academic Freedom), 2.05 (No Discrimination and Duty to Accommodate) or 2.06 (Full and Fair Consideration).
