Recording of Documents. No later than ten (10) days after the Effective Date, Owner shall record or cause to be recorded in the Official Records for Orange County, California, an executed original of this Agreement (or memorandum of this Agreement in a form approved by the City Attorney and Owner). Prior to the issuance of the first certificate of occupancy or a signed job card (that permits occupancy) for a Unit, the Parties shall enter into the Regulatory Agreement and Owner shall cause the Regulatory Agreement to be recorded against the Property. City shall cooperate with Owner in promptly executing in recordable form this Agreement (or memorandum of this Agreement) and the Regulatory Agreement. It is the express intent and agreement between the Parties that during the Total Affordability Term the Regulatory Agreement shall remain binding and enforceable against the Property, the Project, and the Affordable Units to ensure compliance with the State Density Bonus Law and Chapter 2-3 of the Irvine Zoning Ordinance, and to ensure the continued supply of Affordable Units in the Project.
