Common use of Recourse to the courts Clause in Contracts

Recourse to the courts. In the event that the Parties do not agree to refer the matter to arbitration, the Parties agree to submit to the jurisdiction of the Courts of England and Wales and shall be at liberty to issue proceedings. Each Party irrevocably waives any objections which it may have to the choice of venue of any proceedings in any such court and any claim that any such proceedings have been brought in an unconventional forum and further irrevocably agrees that judgment in any proceedings brought in the English courts shall be conclusive and binding upon such Party and may be enforced in the courts of any other jurisdiction.
