Common use of Recovery of Overpayment Clause in Contracts

Recovery of Overpayment. Where an Employee has received more than proper entitlement to wages or benefits, no continuing Employee shall be subject to such deductions in excess of twenty percent (20%) of the Employees net earnings per pay period. If more than one year (1) has passed since the overpayment, there shall be no recovery of the overpayment.
