RECOVERY OF UNDERPAYMENTS. 12.15.1 Subject to Clause 12.15.8, employees who believe they have been underpaid may recover the underpayment according to the terms of this Article 12.15. 12.15.2 Employees who believe they have been underpaid will notify Human Resources and the Union in writing. 12.15.3 The College will investigate the complaint and reply in writing to the employee and the Union within 4 weeks. 12.15.4 If an underpayment is discovered, it will be repaid within 4 weeks. 12.15.5 If the College claims there was no underpayment and the employees or the Union dispute this, the matter will be discussed informally with a Human Resources Representative. 12.15.6 If agreement cannot be reached informally, the matter will be dealt with through Article 10 Grievance Procedure commencing at Step 3. 12.15.7 Employees may only recover underpayments within 1 year of their occurrence. 12.15.8 Employees may choose to recover underpayments through Article 10 Grievance Procedure rather than through the procedure contained in Article 12.15.
