E. The Board shall give written notice of recall from Layoff by sending a return receipt requested or certified letter to said NTPSM at his/her last known address. It shall be the responsibility of each NTPSM to notify the Board of any change of address. D. A list of employees on layoff shall be made available to all worksites. Such employees shall be offered the day opportunity to substitute in their laid- off classification before other or non-employees are utilized. If utilized such employees shall receive the PSM signed substitute rate of pay. 12.2 Subject to the contractpreceding paragraphs, a bumping procedure shall be utilized to layoff in succession the most junior employees provided the remaining employees are able and qualified to perform the work remaining. In the circumstances event other Board effectuates the bumping procedure as described herein and as a result of more than one (1) PSM signing their contract on such procedure an employee bumps into a position which he/she had bumping rights and the same dayemployee refuses to accept the assignment, all PSMs so affected will participate in the Board may dismiss the employee for refusal to accept the assignment. The right to waive bumping rights and accept layoff shall be limited to those layoff situations where a drawing reduction of hours is effectuated and shall not apply to determine position on an employee who suffers layoff as a result of the Board reducing the number of employees. 12.3 The Board shall provide the Union with a copy of the seniority list within 30 days from register at the starting date. REDUCTION IN PERSONNEL. A. If Lay-Off Procedure. It is recognized by the Board desires parties to reduce this Agreement that such things as lack of finances, changes in educational programs and decreases in enrollments may necessitate reduction in the number of PSMsteaching staff. In order to promote an orderly reduction, the following procedures shall procedure will be used: 1. If a displaced teacher is certified but not qualified to bump any junior teacher, the displaced teacher may bump the teacher with the least seniority assigned to a position for which the displaced teacher is certified provided: (a) The displaced teacher has more seniority. (b) The displaced teacher shall have the opportunity to become certified and qualified prior to the start of the position. (c) The displaced teacher will have two (2) years to become certified and qualified. The Board shall reimburse the displaced teacher for 100% of the actual cost of the tuition for the courses required for qualification. 9. Seniority will be defined as continuous service as a teacher with Grass Lake Community Schools, starting with the individual's date of hire. 10. Recall from layoff shall be in inverse order of Layoff provided he/she layoff for positions for which the teacher is State certified for the vacancyand qualified. No new NTPSMs teachers shall be employed by the Board while there are NTPSMs who were in teachers of the bargaining unit District laid off who are laid off, unless there are not certified and qualified to fill the vacancy. 11. Notice of recall to any laid off NTPSMs teacher may be by telephone if the teacher can be reached, with proper State certification to fill any vacancy which may arise. E. The Board shall give written a confirmation by mail sent immediately thereafter by the Board. If the teacher is not reached by telephone, notice of recall from Layoff will be by sending a return receipt requested certified or certified letter registered mail to said NTPSM the laid off teacher at his/her his last known address. In the event of a reduction of personnel, the affected teachers shall be given asas much advance notice as possible, but not less than forty-five (45) days advance notice. It is agreed that said forty-five (45) days notice shall be sufficient if notified by the Administration of its intent to recommend the reduction to the Board. For personnel to be laid off at the end of the school year, the Board of Education will attempt to make the notification no later than May 1. The Technology Center has decided to implement the use of stipends for the participation in their School Improvement Committee for times that are during non-work hours as follows: School Improvement Chair $200 School Improvement Member $100 School Improvement Sub-Committee Chair $100 (Chair should be SIC member, not the SIC chair.) REDUCTION IN PERSONNEL. A. If No teacher shall be laid off pursuant to a necessary reduction in personnel unless there is a decrease or lack of revenue, a decrease in the number of students enrolled, or changes beyond the control of the Board desires in the curriculum or facilities or an outside agency impact on the district. B. Before the Board makes any necessary reduction in personnel, it will first negotiate with the Association regarding the effects of such reduction. This will include, but not be limited to, such problems as the criteria used for the determination as to who will be discharged or laid off and the reemployment rights of such persons. Layoff shall not include the failure to fill terminations or teachers being displaced due to other teachers returning from leaves. Existing staff that have been transferred to fill a vacancy created by a leave shall fall under Article XXI A above. 1. In the event that a reduction of staff is deemed necessary, leaves of absence without pay will automatically be granted to any and all teaching staff affected by this reduction. These leaves of absence shall not prohibit the teachers from seeking and accepting gainful employment elsewhere, and shall not be terminated for that reason except on written request of the teacher. 2. During said leave of absence such teacher shall receive no insurance benefits at Board expense, but may elect to continue insurance benefits at his/her own expense. This section is contingent upon approval by the respective insurance carriers. 3. During said leave of absence such teacher's seniority shall remain unbroken despite such leave, and his/her accumulated sick leave shall not be canceled, but shall remain credited to him/her. 4. Any teacher who would have qualified for full state retirement during the reduction year shall be permitted to teach a year (as determined by the recall procedure outlined below) so as to acquire needed service. 5. The fact that a teacher is placed on leave of absence for the purpose of staff reduction shall not result in the loss of status or credit for previous years of service. Upon return to the Mt. ▇▇▇▇▇▇ District, he/she shall assume the step position on the salary schedule which he/she would have held had he/she been actively employed in the Mt. ▇▇▇▇▇▇ District for the same period provided he/she remains in the teaching field. 6. Layoffs shall not include failure to fill terminations or the failure to reemploy teachers who are being displaced by teachers returning from leave. Existing staff members who have been transferred to fill vacancies caused by leaves shall fall under Paragraph C. C. In the event that it becomes necessary to reduce the number of PSMsteachers, through layoff, from employment by the following procedures Board, then the teachers with the most seniority in the District who are certified and meet the Highly Qualified standards shall be used: 1retained. The teacher shall notify the Personnel Office by March 15 of the current school year of his/her intent to return to the Mt. ▇▇▇▇▇▇ District the following year. No new staff shall be hired until all staff on layoff in line with their seniority, qualifications, and certification has been offered an opportunity in writing to return to active employment. It is the teacher's responsibility to keep his/her current address with the Personnel Office.

Seniority The determination of whether a position was the same as or similar to an individual’s current position shall be made solely by the Board after comparing the legal requirement, job description, and applicable skills of the current position with the former position. (2) If a tie remains after the application of the procedures as described above, then the order of dismissal and/or recall will be determined based on the date of the Board meeting at which the affected ESPs were hired. (3) If a tie remains after the application of the procedures as described in 1 and 2 above, then the order of dismissal and/or recall will be determined based on the order the affected ESPs are listed on the Board agenda for the Board meeting at which they were hired, with those being listed first on the Board agenda having seniority over those listed later on the agenda. C. Reductions in force within a category of position shall be made in reverse seniority order, with the least senior full-time ESPs in the category being removed first until the necessary reduction has been made, provided more senior full-time ESPs within the category are qualified to hold the positions of the less senior full-time ESPs. In determining an employee's qualifications for purposes of reduction-in- force, the Board shall consider any statutory or regulatory employment pre-requisites and the specific skills required for the position as determined by the Board in its policies, rules, regulations, or job descriptions. D. The Parties also recognize that part-time ESPs shall not accrue while the PSM is on an unpaid leave. C. In the circumstances of more than one (1) PSM beginning employment on the same date who is State certified in the same areas, the seniority date shall be the day the PSM signed the contract. After the initial 30 minutes, additional time may be tracked in 15 minute increments: • Pre-approved parent-teacher conferences • Pre-approved meetings outside the regular work schedule (e.g., IEPs, MDRs, parent meetings) • Pre-approved activities assigned by an administrator and completed outside of regular work • Student emergencies or crises will be post-approved (usually automatic) • Mandatory meetings that run beyond the end of the work day will be granted flex time • Exceptions to the above may be approved by an administrator Flex time may NOT be accumulated for: • Regularly scheduled staff meetings (section VI, D) • Typical paperwork associated with regular job functions (e.g., lesson planning, service capture, report writing, grading) • Social functions • Any task or activity without pre-approval unless on the list above Paperwork and Timelines • All staff must complete flex time documentation shared by their administrator • Flex time is NOT entered into WorkForce • Flex time should be taken in a minimum of 15 minute increments • Staff may not carry a balance of more than three accumulated flex days at any time • Flex time may not be carried over from year to year • Factors that may impact the utilization of flex time include: disruption to student instruction/services/programming, job responsibilities, coverage for classroom and/or excessive absenteeism. • Ancillary staff can use flex time to align with their local district calendars. • Exceptions to the above may be approved by an administrator. C. Any employee notified of reduction may exercise his/her seniority rights into a position, which shall become open as follows: 1. Voluntary layoffs will be accepted The employee directly affected by the Board reduction shall be able to request assignment to the open positions on the basis of seniority provided there remain PSMs who are State certified to fill they possess qualifications for the available positionsposition. 2. Employees who exercise their seniority rights for placement shall do so and shall not have the right to decline placement to the least senior positions. Refusal of such placement shall result in layoff action by the Board. Full time employees shall not be required to accept less than full time employment in such instances, the next senior full-time position in the unit shall become open, and such position shall be laid off according offered to seniority the affected secretary. E. Employees affected by a reduction in staff shall be recalled in reverse order of layoff. The most senior employee shall be recalled to the first opening for which he/she is qualified. The determination of whether a position was the same as or similar to an individual’s current position shall be made solely by the Board after comparing the legal requirement, job description, and applicable skills of the current position with the former position. (2) If a tie remains after the application of the procedures as described above, then the order of dismissal and/or recall will be determined based on the date of the Board meeting at which the affected ESPs were hired. (3) If a tie remains after the application of the procedures as described in 1 and 2 above, then the order of dismissal and/or recall will be determined based on the order the affected ESPs are listed on the Board agenda for the Board meeting at which they were hired, with those being listed first on the Board agenda having seniority over those listed later on the agenda. C. Reductions in force within a category of position shall be made in reverse seniority order, with the least senior full-time ESPs in the category being removed first until the necessary reduction has been made, provided more senior full-time ESPs within the category are qualified to hold the positions of the less senior full-time ESPs. In determining an employee's qualifications for purposes of reduction-in-force, the Board shall consider any statutory or regulatory employment pre-requisites and the specific skills required for the position as determined by the Board in its policies, rules, regulations, or job descriptions. D. A list of employees on layoff shall be made available to all worksites. Such employees shall be offered the opportunity to substitute in their laid- off classification before other or non-employees are utilized. If utilized such employees shall receive the substitute rate of pay. 12.2 Subject to the preceding paragraphs, a bumping procedure shall be utilized to layoff in succession the most junior employees provided the remaining employees are able and qualified to perform the work remaining. In the event the Board effectuates and bumping procedure as described herein and as a result of such procedure an employee bumps into a position in which he/she had bumping rights and the employee refuses to accept the assignment, the Board may dismiss the employee for refusal to accept the assignment. The right to waive bumping rights and accept layoff shall be limited to those layoff situations where a reduction of hours is effectuated and shall not apply to an employee who suffers layoff as a result of the Board reducing the number of employees. 12.3 Employees to be laid off will have at least thirty (30) calendar days notice of layoff. REDUCTION IN PERSONNEL. A. If the Board desires to reduce the number of PSMs, the following procedures shall be used: 1. Voluntary layoffs will be accepted by the Board provided there remain PSMs who are State certified to fill the available positions. 2. If further reductions are made, NTPSMs shall be laid off according to seniority (least senior first), provided there remain NTPSMs who have State certifications, licenses, approvals, or authorizations, in the vacant positions. B. Seniority shall be defined as length of continuous service in the district. Seniority shall not accrue while the PSM is on an unpaid leave. C. In the circumstances of more than one (1) PSM beginning employment on the same date who is State certified in the same areas, the seniority date shall be the day the PSM signed the contract. In the circumstances of more than one (1) PSM signing their contract on the same day, all PSMs so affected will participate in a drawing to determine position on the seniority list within 30 days from the starting date. The Association and PSM(s) so affected will be notified in writing of the date, place and time of the drawing. The drawing shall be conducted openly and at a time and place which will reasonably allow affected PSM(s) and Association Representatives to be in attendance. D. Any NTPSM on Layoff shall be recalled in inverse order of Layoff provided he/she is State certified for the vacancy. No new NTPSMs shall be employed by the Board while there are NTPSMs who were in the bargaining unit who are laid off, unless there are not laid off NTPSMs with proper State certification to fill any vacancy which may arise. E. The Board shall give written notice of recall from Layoff by sending a return receipt requested or certified letter to said NTPSM at his/her last known address. It shall be the responsibility of each NTPSM to notify the Board of any change of address. The NTPSM’s address as it appears on the Board’s records shall be conclusive when used in connection with layoffs, recall or other notice to the NTPSM. In the event of a reduction of personnel, the affected teachers shall be given asas much advance notice as possible, but not less than forty-five (45) days advance notice. It is agreed that said forty-five (45) days notice shall be sufficient if notified by the Administration of its intent to recommend the reduction to the Board. For personnel to be laid off at the end of the school year, the Board of Education will attempt to make the notification no later than May 1. a. All or partial day professional learning that is taking place virtually, b. When a shared space arrangement will not allow the space or privacy needed to complete the work or activity and there isn't an alternative workspace for the employee to use, c. If there is lag time before or after work appointments for which driving to the office would be an inefficient use of time, d. If the staff member is well enough to work, but quarantined (2 days max) per week, and, e. Other times deemed necessary on a case by case basis, pre approved by the supervisor.
