Common use of Reductions/Retention Clause in Contracts

Reductions/Retention. Retention of bargaining unit members and recall of eligible teachers whose contracts have been suspended pursuant to a reduction in force will not be based upon seniority, except in circumstances when choosing between teachers with comparable evaluations. The application of the term “comparable” as applied to teacher evaluations, shall be in accordance with Board's Standards-Based Teacher Evaluation System set forth in the Appendix which has been mutually developed by the parties. For bargaining unit members not subject to the OTES system, decisions on layoff, retention, and recall will be in accordance with seniority. For the transition period of this Agreement only, ending on August 31, 2016, comparable evaluations of OTES teachers will be defined as all evaluation ratings above "Ineffective." However, a teacher who attains a designation of “Ineffective” due predominantly to student growth measures (Value Added data, SLO’s or any combination), for this transition period, will be considered “comparable” with all other teachers. Thereafter, unless the parties negotiate otherwise, comparability will be determined in relation to the effectiveness ratings defined in the Board's standards-based teacher evaluation policy included in this agreement in accordance with Ohio Revised Code Sections 3319.111 and 3319.112.
