REINSTATEMENT AFTER RESIGNATION. 13.19.1 Any permanent employee who voluntarily resigns from his/ her permanent classified position may be reinstated or employed within thirty-nine (39) months after his/her last day of paid service to: (2004-05) a. a position in his/her former classification as a permanent or short term employee, or b. as a permanent or short term employee in a related lower class or a lower class in which the employee formerly had permanent status. (2004-05) 13.19.2 The District shall disregard the break in service of the employee and shall classify him/her as, and restore all rights, benefits, and burdens of, a permanent employee in the class to which he/she is reinstated and re-employed. (2004-05) 13.19.3 Current permanent employees who have been re-employed within thirty-nine (39) months of a previous resignation from the District, prior to the effective date of this section, shall retain any seniority earned prior to such resignation, but all other rights, benefits or burdens shall be restored prospectively, i.e., as of the first of the month following ratification of this contract.
