Common use of Rejected Work Clause in Contracts

Rejected Work. District shall have the right to reject Contractor's defective work. Contractor shall promptly eliminate all defects free of charge. If Contractor fails to eliminate all defects within a reasonable time, District may eliminate the defects, or hire another contractor to eliminate the defects and charge the expense of eliminating the defects to Contractor. If District deems it inexpedient to correct a defect, District may reduce the fee payable to Contractor by an amount that in District’s sole judgment reflects the diminished value of the work represented by the defect. District's rights under this paragraph shall be in addition to and not in lieu of all rights District may otherwise have in the event Contractor produces defective work.
