Common use of Relationship to the Award and the NES Clause in Contracts

Relationship to the Award and the NES. 5.1 This Agreement is to be read in conjunction with the terms and conditions of the Award and such terms and conditions will be maintained for the life of the Agreement. 5.2 Where there is any inconsistency between the terms and conditions of the Agreement and those in the Award, the provisions of the Agreement must prevail. 5.3 This Agreement is not intended to operate in any way that is less beneficial than the NES. If a provision of the Agreement could be interpreted as being less beneficial than the NES, the NES will apply.
