Release by Participating and Non-Participating Class Members Who Are Aggrieved Employees. All Participating and Non-Participating Class Members, who are Aggrieved Employees, are deemed to release, on behalf of themselves and their respective former and present representatives, agents, attorneys, heirs, administrators, successors, and assigns, the Released Parties from all claims for PAGA penalties that were alleged, or reasonably could have been alleged, based on the facts stated in the Operative Complaint and PAGA Notice that occurred during the PAGA Period.
Release by Participating and Non-Participating Class Members Who Are Aggrieved Employees. All Participating and Non-Participating Class Members, who are Aggrieved Employees, are deemed to release, on behalf of themselves and their former and present representatives, agents, attorneys, heirs, administrators, successors, and assigns, the Released Parties from all claims for PAGA penalties that were alleged, or reasonably could have been alleged, based on the facts stated in the Operative Complaint and PAGA Notice that occurred during the PAGA Period. This includes, but is not limited to, claims for civil penalties based on alleged violations of Labor Code sections 201, 202, 203, 204, 218.5, 221, 226(a), 226.3, 226.7, 229, 245-249 (Healthy Workplaces, Healthy Families Act of 2014), 510, 512(a), 558, 1174(d), 1174.5, 1194, 1197, 1197.1, 1198, 2800, and 2802, and applicable IWC Wage Orders.

(1) failure to pay for all hours worked, including overtime hours worked; (2) failure to pay minimum wage for all hours worked; (3) failure to provide compliant meal breaks; (4) failure to provide compliant rest breaks; (5) failure to provide place of employment that is safe and healthful; (6) failure to reimburse for required business expenses; (7) failure to pay accrued vacation upon separation; (8) failure to timely pay all wages owed, and (9) failure to provide accurate itemized wage statements and violating record keeping requirements, based on the following sections of the California Labor Code: 200-204, 218, 222, 226, 226.7, 227.3, 510, 512, 558, 1194, 1197, 1198, 2802, 6400-6404, 6407, and 2698 et seq.

All Participating and Non-Participating Class Members who are Aggrieved Employees are deemed to release, on behalf of themselves and their respective former and present representatives,agents, attorneys, heirs, administrators, successors, and assigns, the Released Parties from any liability for civil penalties recoverable under PAGA for violations during the PAGA Period under PAGA based on any factual or legal theories that were alleged in the Operative Complaint or LWDA notice or arise from facts alleged in the Operative Complaint or LWDA notice, including for the following California Labor Code sections: 201, 202, 203, 204, 226, 226.7, 246, 510, 512 and 2802. PAGA Employees shall not waive section 1542 of the California Civil Code.
