Common use of Release Indemnity Clause in Contracts

Release Indemnity. 6.1 You agree: (a) not to make any claim or demand against Us; (b) to release Us from any liability (to the extent permitted by law); and (c) to indemnify Us and keep us indemnified, in relation to: (d) any claim, demand, suit, proceeding or other action made against Us; or (e) damage, cost, expense or any other form of loss We may suffer or incur, caused or contributed to by, or arising out of or in connection with: (f) the use and/or occupation of the Berth, the Marina, the Common Areas, the Facilities Areas, the Precinct and/or the Surrounding Environment by You or Your Associates; (g) any damage, loss, injury or death caused or contributed to by any act, omission, negligence or default of You or Your Associates; and/or (h) Your breach of, or failure to observe the terms and conditions of, this Agreement, except to the extent any such loss is caused by Our own negligence.
