Common use of Release of Plaintiffs Clause in Contracts

Release of Plaintiffs. (1) Upon the Effective Date, the Plaintiffs and each Settlement Class Member shall be deemed to have, and by operation of the Final Order and Judgment shall have, fully, completely and forever released, acquitted and discharged the Released Parties from all Released Claims. (2) Upon the Effective Date, with respect to the Released Claims, the Plaintiffs and all Settlement Class Members to whom such statute or rule is applicable, expressly waive and relinquish, to the fullest extent permitted by law, the provisions, rights, and benefits of § 1542 of the California Civil Code, which provides: creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor. (3) Upon the Effective Date, the Action shall be deemed dismissed with prejudice.
