Relevant Consents. Applying for and using all reasonable endeavours to obtain all Relevant Consents from time to time as may be appropriate before and throughout the course of the Project. Keeping the Employer’s Representative fully informed of the progress of the Contractor's applications for those Relevant Consents and, if and when they are obtained, supplying the Employer with complete and full details of those applications together with copies of all consents. Appealing against the refusal or taking such other action as may be appropriate to proceed with the Project if such a Relevant Consent is refused, subject to the approval of the Employer (such approval not to be unreasonably withheld). Relevant Consents. 1. Bidders are responsible for identifying and obtaining all Relevant Consents for the construction, implementation, commissioning and operation of the Facility. 2. A Preferred Bidder is required to have full grant of planning permission for its Tender on the Conclusion of Agreements Date or such later date as determined by the Commission, in its sole discretion. 3. The Commission reserves the right to examine any conditions, which may attach to planning permission, with a view to assessing whether they may have any adverse impact on the Scheduled Commercial Operation Date.
