Removal of Collateral Clause Samples
The 'Removal of Collateral' clause defines the conditions under which collateral that has been pledged or provided as security can be withdrawn, released, or substituted. Typically, this clause outlines the requirements that must be met before collateral can be removed, such as repayment of the secured obligation or obtaining the secured party's consent. For example, it may specify that collateral cannot be removed until a loan is fully repaid or replaced with equivalent security. The core function of this clause is to protect the interests of the secured party by ensuring that collateral remains available as security until the underlying obligations are satisfied, thereby reducing the risk of loss.
