Common use of Replacement of Arbitrators Clause in Contracts

Replacement of Arbitrators. If during arbitration proceedings the original arbitration panel, or some of its members, are unable to participate, withdraw, or need to be replaced because the member does not comply with the requirements of the Code of Conduct in Annex 8 (Code of Conduct for Arbitrators and Mediators), the procedure set out in Article 3.7 (Establishment of the Arbitration Panel) applies. The time limit for the notification of the reports and rulings, as the case may be, shall be extended by 20 days.

If during in an arbitration proceedings proceeding under this Chapter, the original arbitration panel, or some of its members, are unable to participate, withdraw, or need to be replaced because the member does they do not comply with the requirements of the Code of Conduct set out in Annex 8 (Code of Conduct for Arbitrators and Mediators)XXI to this Agreement, the procedure set out in Article 3.7 (Establishment 249 of the Arbitration Panel) appliesthis Agreement shall apply. The time time-limit for the notification of the reports and rulings, as the case may be, arbitration panel ruling shall be extended by 20 days with the exception of the urgent disputes referred to in paragraph 7 of Article 249, for which the time-limit shall be extended by five days.
