The Replacement Project Superintendent clause establishes the process and conditions under which the project superintendent assigned by the contractor can be replaced during the course of a project. Typically, this clause requires the contractor to notify the owner and sometimes obtain approval before substituting the superintendent, ensuring that any replacement is suitably qualified and familiar with the project. Replacement Project Superintendent. If the Contractor terminates the Project Superintendent or, if the Contractor, for any reason, engages a Project Superintendent different from the one originally assigned to the Project, Contractor must ensure that the replacement Project Superintendent has similar qualifications and experience as the originally identified Project Superintendent. Furthermore, the Contractor must obtain the Owner's prior written approval before engaging a permanent replacement Project Superintendent.

Rain Water, Surface Water, and Back-up. The Contractor shall protect all Work, including but not limited to, excavations and trenches, from rainwater, surface water, and back up of drains and sewers. The Contractor shall furnish all labor, pumps, shoring, enclosures, and equipment necessary to protect and to keep the Work free of water.
