Reporting Non-Permitted Use or Disclosure. Business Associate will promptly report to the Plan any use or disclosure of Individuals’ PHI not permitted by this Agreement or in writing by the Plan or its Plan administrator, of which Business Associate becomes aware. In addition to reporting to Plan any use or disclosure of PHI not permitted by the Agreement, Business Associate will also report any security incidents of which Business Associate becomes aware. A security incident is an attempted or successful unauthorized access, use, disclosure, modification or destruction of information or interference with system operations in an information system.
