Reporting Results. a. The laboratory shall report tests results to the MRO within ten (10) business days after receipt of the specimen by the laboratory. b. The laboratory shall report as negative to the MRO all specimens, which are negative on the initial, test or are negative on the confirmation test. Only specimens, which are confirmed as positive on the confirmation test, shall be reported positive to an MRO for a specific drug. c. The laboratory shall transmit results to the MRO in a manner designed to ensure confidentiality of the information. The laboratory and MRO must ensure the security of the data transmission and restrict access to any data transmission, storage, and retrieval system. d. The MRO and/or the tested employee may request from the laboratory, and the laboratory shall provide, quantitation of test results. e. The MRO will also verify that positive and negative test results were properly analyzed and handled. The MRO will have knowledge of substance abuse disorders and shall also be knowledgeable in the medical use of prescription drugs and in the pharmacology and toxicology of illicit drugs. The MRO shall evaluate the drug test results which are reported by the laboratory, verify the drug test results by checking the chain of custody form that the specimen was collected, transported and analyzed under proper procedures as set forth in this policy. f. The MRO will initially notify the employee or job applicant of a confirmed positive test result within five (5) business days of receipt of the test result from the laboratory, and determine if any alternate medical explanations caused a positive test result. This notification may be accomplished via telephone. This determination by the MRO shall include conducting a medical interview with the employee or job applicant, review of the employee’s or job applicant’s medical history, review of any other relevant bio-medical factors, a review of all medical records made available by the tested employee or job applicant, and an inquiry as to whether any prescription or non- prescription medications could have caused the positive test result. The MRO will provide an opportunity for the employee or job applicant to discuss the positive test result and to submit documentation of any prescriptions relevant to the positive test result for up to five (5) business days after notification period. g. The MRO will then communicate the test results of an employee or job applicant to a designated representative of Palm Beach County and the employee or job applicant. The test results shall be communicated only after the MRO has verified that the positive and/or negative test results were properly analyzed and handled and, in the case of a positive test result, the MRO has provided at least up h. The Medical Review Officer shall require that the employee produce any necessary written proof, and the employee shall authorize the Medical Review Officer to submit documentation of any prescriptions relevant to obtain further information from his or her health care providers. In the event that both urine samples are positive, and if independent testing of Palm Beach County the same sample, if employed by the employee and the Union, is positive, then the employee will be relieved of duty with vacation, sick pay, and/or compensable leave, to the extent available, or job applicant on leave without pay if not, pending completion of an employer and Union approved a copy certified drug rehabilitation program (which may be inpatient or outpatient, including but not limited to counseling). Upon a positive test, the employee shall be referred to a Substance Abuse Professional (“SAP”). The employee shall be evaluated by the SAP and shall follow the recommendations of the test results subject SAP. The employee shall execute a limited waiver authorizing the SAP and any treating professional to certify to the Town that the employee protection provision (Section J) and the confidentiality provision (Section N) of this Articleis in compliance with any treatment program.

Reporting Results. a. (1) The laboratory shall will report tests test results to the County's MRO within ten (10) business an average of 5 working days after receipt of the specimen by the laboratory. Before any test result is reported (the results of initial tests, confirmatory tests, or quality control data), it will be reviewed, and the test certified as an accurate report by the laboratory's responsible individual. The report will identify the drugs/metabolites for which tests are conducted, whether results are positive or negative, the specimen number assigned by the County, and the drug testing laboratory specimen identification number.
b. (2) The laboratory shall will report as negative to the MRO all specimens, specimens which are negative on the initial, initial test or are negative on the confirmation confirmatory test. Only specimens, which are specimens confirmed as positive on the confirmation test, shall will be reported positive to an MRO for a specific drug.
c. (3) The MRO may request from the laboratory and the laboratory must provide quantitation of test results. The MRO must report whether the test is positive or negative and may report the drug(s) for which there was a positive test, but will not disclose the quantitation of test results to the department. The MRO may reveal the quantitation of a positive test result to the department, the employee, or the decision maker in a lawsuit, grievance, or other proceeding initiated by or on behalf of the employee, and arising from a verified positive test.
(4) The laboratory shall may transmit results to the MRO by various electronic means (e.g., teleprinter, facsimile, or computer) in a manner designed to ensure confidentiality of the information. Results may not be provided verbally by telephone. The laboratory and MRO must Addiction Medical Consultants, Inc. (AMC) will ensure the security of the data transmission and restrict limit access to any data transmission, storage, and retrieval system.
d. The MRO and/or the tested employee may request from the laboratory, and the laboratory shall provide, quantitation of test results.
