Representation Fee. A. Representation Fee. 1. The Association shall, on or before October 1, deliver to the Board a written statement containing the following:

Once during each membership year covered in whole or in part by this Agreement, the Association will submit to the Board a list of those faculty members who have not failed to arrange for and become members of the Association for and a request that the then current membership yearrepresentation fee of such nonmembers be deducted in accordance with the Agreement.
2. Beginning with the first full pay period in November, the Board will commence deductions from salaries of such employees in accordance with paragraph 3 below, the full amount of the representation fee and will promptly transmit the amount so deducted to the Association.
3. Pay deduction schedule: The Board will shall deduct the representation fee in equal installmentsequally, as nearly as possible, from the paychecks paid to each faculty member who is not a member employee on the aforesaid list, during the remainder of the Association.membership year in question. The deductions will begin with the first paychecks:

b. (a) Within 21 days after receipt of the aforesaid list by the Employer; or

In the event Teamster Local 11 fails to maintain such a system, or if membership is not so available, the Employer shall immediately cease making said deductions.
I. The Association Union shall indemnify and save the Board Employer harmless from any and all claims, demands, suits, or any other action arising from claims raised against it by an employee as a result of fulfilling its obligations under this Article.

If a faculty member declines to of the bargaining unit represented by the Association does not become a member of the Association during any membership year (i.e., from September 1 to the following August 31) which is covered in whole or in part by this Agreement, said faculty that bargaining unit member will be required to pay a representation fee to the Association for that the membership year. The purpose of this fee will be year to offset the per capita cost costs of services rendered by the Association as majority representative.

The Association will notify agrees to indemnify and hold the Board harmless against any liability for damages which may arise by reason of any action taken by the Board in writing of any changes in the list provided for in paragraph C. above and/or the amount of the representation fee, and such changes will be reflected in any deductions made more than 30 days after the Board receives said notice.

On or about the last day of each month, beginning complying with the month provisions of this Agreement becomes effective, the Board will submit to the Association a list of all employees who began their employment in a bargaining unit position during the preceding 30 daysArticle. Once during 23.2 Prior to March 1, 1984 and prior to the beginning of each membership year covered in whole or in part by this Agreementthereafter, the Association will submit to the Board a list of those faculty members employees who have are not become members of the Association for the then current membership year. The Board will deduct from the salaries of such employees, in accordance with Section 23.3 below, the full amount of the representation fee and will transmit promptly the amount so deducted to the Association.
23.3 The Board will deduct the representation fee in equal installments, installments as nearly as possible, from the paychecks paid to each faculty member employee on the aforesaid list. The deductions will begin with the first paycheck paid:
(a) 30 days after receipt of the aforesaid list by the Board; or
(b) 30 days after the employee begins his or her employment in a bargaining unit position, unless the employee previously served in a bargaining unit position and continued in the employ of the Board in a non-bargaining unit position or was re-employed in such unit from a reemployment list, in which event the deductions will begin with the first paycheck paid 10 days after the resumption of the employee's employment in a bargaining unit position, whichever is later.
23.4 In the event an employee who is not required to pay a member representation fee terminates his or her employment with the Board before all deduction are made, the Board shall deduct the unpaid portions of the Associationfee from the last paycheck paid to said employee during the membership year in question.
