Common use of Representations and Warranties Regarding the Trust Depositor Clause in Contracts

Representations and Warranties Regarding the Trust Depositor. By its execution of this Agreement and each Subsequent Transfer Agreement, the Trust Depositor represents and warrants to the Issuer, the Indenture Trustee, the Holders and the Swap Counterparties that: (a) Confirmation of the Originator’s Representations and Warranties. The representations and warranties set forth in Section 3.01, Section 3.02, Section 3.03, Section 3.04 and Section 3.05 of this Agreement and in the ACAS Transfer Agreement are true and correct.

Representations and Warranties Regarding the Trust Depositor. The representations and warranties set forth in Section 3.01, Section 3.02, Section 3.03, Section 3.04 and Section 3.05 of this Agreement and in the ACAS Transfer Agreement are true and correct.

Representations and Warranties Regarding the Trust Depositor. The representations and warranties set forth in Section 3.01, Section 3.02, Section 3.03, Section 3.04 and Section 3.05 of this Agreement and in the ACAS Transfer Agreement are true and correct.
