Common use of Request by Borrower Clause in Contracts

Request by Borrower. Any request by the Borrower for a Loan or Letter of Credit shall be in writing, or by telephone promptly confirmed in writing, and must be given so as to be received by the Agent not later than: (i) 10:00 a.m., Minneapolis time, on the Business Day of the requested Loan, if the Loan shall be comprised of Prime Rate Advances; (ii) 10:00 a.m., Minneapolis time, three Business days prior to the date of the requested Loan, if the Loan shall be, or shall include, a Eurodollar Advance; or (iii) 10:00 a.m., Minneapolis time, three Business days prior to the date of any requested Letter of Credit. Each request shall specify (1) the borrowing date (which shall be a Business Day), (2) the amount of such Loan and the type or types of Advances comprising such Loan, (3) if such Loan shall include Eurodollar Advances, the initial Interest Periods for such Advances, and (4) if a request for a Letter of Credit, the form of such Letter of Credit and such other information as the Agent shall reasonably request.

Request by Borrower. Any request by the Borrower for a Loan or Letter of Credit shall be in writing▇▇ ▇▇▇▇▇ng, or by telephone promptly confirmed in writing, and must be given so as to be received by the Agent not later than: (i) 10:00 a.m.1:00 p.m., Minneapolis time, on one Business day prior to the Business Day date of the requested Loan, if the Loan shall be comprised of Prime Base Rate Advances; (ii) 10:00 a.m.12:00 noon, Minneapolis time, three Business days prior to the date of the requested Revolving Loan, if the Revolving Loan shall be, or shall include, a Eurodollar Advance; or (iii) 10:00 a.m.12:00 noon., Minneapolis time, three Business days prior to on the date of any requested Letter of CreditSwing Line Loan. Each request for a Loan shall specify (1) the borrowing date (which shall be a Business Day), (2) the amount of such Loan and the type or types of Advances comprising such Loan, and (3) if such Loan shall include Eurodollar Advances, the initial Interest Periods for such Advances, and (4) if a request for a Letter of Credit, the form of such Letter of Credit and such other information as the Agent shall reasonably request.
