Common use of Requests for Assistance Clause in Contracts

Requests for Assistance. 1. Requests for assistance shall be made in writing, signed by the Chairman of the Requesting Authority or any other person authorized by the laws and regulations of the authorities to do so. The requests shall be addressed to the contact person of the Requested Authority listed in Annex A. 2. The Request should specify the following: a. a description of the subject matter of the request and the purpose for which the information is sought and the reasons why this information will be of assistance; b. a description of the specific information, documents or assistance requested by the Requesting Authority; c. a description of the facts that constitute the grounds for the suspicion that the offence that is the subject of the request has been committed, and of the connection between these facts and the assistance requested; d. a short description of the relevant provisions that may have been violated and, if known to the Requesting Authority, a list of the persons or institutions believed by the Requesting Authority to possess the information sought or the places where such information may be obtained and the details that support this belief, to the best of the Requesting Authority’s knowledge; e. in so far as the request concerns information relating to transactions in specific securities, the Requesting Authority should provide at least, but not limited to, the following: • a description of the securities in question as precise as possible (including e.g. the relevant code), • the names of those firms with whose transactions in the securities the Requesting Authority is concerned, • the dates between which transactions in the securities are considered relevant for the purposes of the request, • the names of any firms and persons on whose behalf relevant transactions in the securities are believed or suspected to have been entered into; f. in so far as the request relates to information concerning the business or activities of any person, such precise information as the Requesting Authority is able to provide so as to enable such persons to be identified; g. an indication of the sensitivity of the information contained in the request and whether the Requesting Authority agrees that the request shall be disclosed to persons whom the Requested Authority may need to approach for information; h. whether the Requesting Authority is or has been in contact with any other authority or law enforcement agency in the jurisdiction of the Requested Authority in relation to the subject matter of the request; i. any other authority whom the Requesting Authority is aware has an active interest in the subject matter of the request; j. an indication of the urgency of the request, or the desired time period for the reply; and ▇. a declaration that any information or document transferred to the Requesting Authority pursuant to the request shall be used solely for the purpose for which it was delivered.

Requests for Assistance. 1. The requests shall be addressed to the contact person of the Requested Authority listed in Annex A. 2. The In case of emergency, requests for information and replies to such requests may be transmitted orally provided that these requests are confirmed in the manner required in this Article unless the Requested Authority agrees to waive such requirements. 3. To the extent available to the Requesting Authority and in order to facilitate the Requested Authority's work the Request should specify the following: a. a description of the subject matter of the request and the purpose for which the information is sought and the reasons why this information will be of assistance; b. a description of the specific information, documents or assistance information requested by the Requesting Authority; in case of discharging its responsibilities pursuant to its respective laws and regulations, the Requesting Authority shall also name these laws and regulations; c. a description of the facts that constitute the grounds for the suspicion that the offence that is the subject of in so far as the request has been committedresults from investigations of violations of any laws or regulations, and of the connection between these facts and the assistance requested; d. a short description of the relevant provisions that may have been violated and, if known to the Requesting Authority, a list of the persons or institutions believed by the Requesting Authority to possess the information sought or the places where such information may be obtained and the details that support this belief, to the best of the Requesting Authority’s knowledge; e. d. in so far as the request concerns information relating to transactions in specific securities, the Requesting Authority should provide at least, but not limited to, the following: • a description of the securities financial instruments in question as precise as possible (possible, including e.g. the relevant code), legislation relating to them. • the names of those firms with whose transactions dealings in the securities financial instruments the Requesting Authority is concerned, • the dates between which transactions in the securities financial instruments are considered relevant for the purposes of the request, • the names of any firms and persons on whose behalf relevant transactions in the securities financial instruments are believed or suspected to have been entered into; f. e. in so far as the request relates to information concerning the business or activities of any person, such precise information as the Requesting Authority is able to provide so as to enable such persons to be identified; g. f. an indication of the sensitivity of the information contained in the request and whether the Requesting Authority agrees is content for the fact that it has made the request shall to be disclosed to persons whom the Requested Authority may need to approach for information; h. g. whether the Requesting Authority is or has been in contact with any other authority or law enforcement agency in the jurisdiction State of the Requested Authority in relation to the subject matter of the request; i. h. any other authority Authority of another state whom the Requesting Authority is aware has an active interest in the subject matter of the request; j. i. an indication of the urgency of the request, or the desired time period for the reply; and. ▇. j. a declaration that any information or document transferred to the Requesting Authority pursuant to the request shall be used solely for the purpose for which it was delivered.

Requests for Assistance. 1. Requests for the provision of Information or other assistance shall will be made in writingwriting or made orally and, unless otherwise agreed, confirmed in writing within ten (10) business days. A request will be signed by the Chairman of the Requesting Authority or any other person authorized by the laws authority and regulations of the authorities to do so. The requests shall be addressed to the contact person of the Requested Authority listed referred to in Annex A. 2. The Request Requests for assistance should specify include the following: a. a description of the subject matter of the request and the purpose for which the information Information is sought and the reasons why this information Information will be of assistance; b. a description of the specific information, documents Information or other assistance requested by the Requesting AuthorityAuthority (identity of Persons, specific questions to be asked, etc.); c. how the Information is likely to be used, including details of any likely onward disclosure by the Requesting Authority, and the purpose such disclosure would serve; d. a description of the facts that constitute the grounds for the suspicion that the offence that is the subject of the request has been committed, and of the connection between these facts and the assistance requested; d. ; e. a short description of the relevant provisions Laws that may have been violated and, if known to the Requesting Authority, a list of the persons or institutions Persons believed by the Requesting Authority to possess the information Information sought or the places where such information Information may be obtained and the details that support this belief, to the best of the Requesting Authority’s knowledge; e. f. an indication of any special precautions that should be taken in so far as collecting the request concerns information relating Information due to transactions investigatory considerations, including the sensitivity of the Information contained in specific securities, the request; g. if Information is provided by the Requesting Authority should provide at least, but not limited tofor confirmation or verification, the following: • a description Information and the kind of the securities in question as precise as possible (including e.g. the relevant code)confirmation or verification sought; h. those Agencies, • the names if any, to whom onward disclosure of those firms with whose transactions in the securities Information provided to the Requesting Authority is concerned, • the dates between which transactions in the securities are considered relevant for the purposes of the request, • the names of any firms and persons on whose behalf relevant transactions in the securities are believed or suspected to have been entered into; f. in so far as the request relates to information concerning the business or activities of any person, such precise information as the Requesting Authority is able to provide so as to enable such persons likely to be identified; g. an indication of the sensitivity of the information contained in the request and whether the Requesting Authority agrees that the request shall be disclosed to persons whom the Requested Authority may need to approach for information; h. whether the Requesting Authority is or has been in contact with any other authority or law enforcement agency in the jurisdiction of the Requested Authority in relation to the subject matter of the requestnecessary; i. any other authority whom matters specified by the Requesting Authority is aware has an active interest and by Laws in relation to the subject matter of the requestRequested Authority; j. an indication of the urgency of the request, or the desired time period for the reply; and ▇. a declaration that any information Information or document transferred to the Requesting Authority authority pursuant to the request shall be used solely for the purpose for which it was delivered. 3. In urgent circumstances, requests for assistance may be effected by telephone or facsimile, provided such communication is confirmed through an original, signed document.
