(iii) Umbrella/Excess Liability in excess of Commercial General Liability, Automobile Liability and Employers’ Liability coverages which is at least as broad as these underlying policies with a limit of liability of $10,000,000.00. (iv) All-Risk Property (Special Cause of Loss) Insurance on the Improvements in an amount not less than the full insurable value on a replacement cost basis of the insured Improvements and personal property related thereto. During any construction period, such policy shall be written in the so-called “Builder’s Risk Completed Value Non-Reporting Form” with no coinsurance requirement and shall contain a provision granting the insured permission to occupy prior to completion. Such policy shall not contain an exclusion for terrorist losses. However, if such an exclusion exists in the All-Risk policy, a separate Terrorism policy covering Certified Acts of Terrorism must be evidenced to Lender in an amount equal to the full replacement cost of the Improvements. Required Insurance Coverage. The Permittee shall purchase and maintain comprehensive general liability insurance naming the “City of Bethlehem and its officers and employees” as additional insureds for a minimum of $1,000,000.00 per occurrence and general aggregate of $1,000,000.00. If consultant owns no vehicles, this requirement may be satisfied by a non-owned auto endorsement to the general liability policy described above. If Consultant or Consultant’s employees will use their personal automobiles in any way in performing Services, Consultant shall provide evidence of personal automobile liability coverage for each such person; and (d) When the law establishes a professional standard of care for the Consultant’s Services, Professional Liability Insurance coverage in an amount of not less than One Million Dollars ($1,000,000.00). Consultant shall maintain such coverage for at least one (1) year after the termination of this Agreement. The Building Official, with the consent of the City’s Risk Manager, is hereby authorized to waive or reduce the requirements set forth above in the event the Building Official determines that such waiver or reduction is in City’s best interest.
