Time being of the essence of this Contract, and a material consideration thereof, it is mutually agreed by the parties hereto in case of the Contractor’s failure to complete the construction within the time specified, the Owner will be damaged thereby. The Contractor shall commence performance of its activities on the Site within five days of the date specified in the Proceed Order. The Contractor shall complete construction, except for Minor Items and Permitted Incomplete Work (Scheduled Warranty Items) (see Article 6.1.1), not later than the Material Completion and Occupancy Date, as adjusted by Change Order.
