Research Plan Test Data. Any and all additional interpretations of any test data, analytical reports, and other information gathered or developed throughout the Research Plan period. All such reports, information, and relevant data constituting proprietary business records are to remain confidential, to the extent allowed by law, for a period of no less than twenty four (24) months from delivery of such reports, information, and relevant data, subject to Sections 7.7 and 7.8 and if marked or designated “confidential,” or words to that effect, by the Lessee.

In relation to each of the Performance Milestones each commercialization report will include sufficient information to demonstrate achievement of those Performance Milestones and will set out timeframes and plans for achieving those Performance Milestones which have not yet been met.
