Reserved Housing Unit. The Unit described in and conveyed by this Deed is
Reserved Housing Unit. The Buyer acknowledges and confirms Buyer’s understanding that the Unit which Buyer is purchasing under this Agreement has been designated by Seller as one of the one hundred (100) reserved housing owner occupant units to be situated within the Project and is being offered and sold by Seller only to eligible and qualified reserved housing buyers in accordance with in accordance with the terms, conditions and requirements of the Kaka`ako Reserved Housing Rules for the Kaka`ako Community Development District established pursuant to Section 206E of the Hawaii Revised Statutes (Title 15, Department of Business, Economic Development & Tourism; Subtitle 4, Hawaii Community Development Authority (HCDA); Chapter 218 of the Hawaii Administrative Rules) and administered by the HCDA (the “Kaka`ako Reserved Housing Rules”). Buyer is required to execute and deliver as part of Buyer’s purchase of the Unit an Affidavit of Eligibility to Purchase Reserved Housing Unit on a form prescribed by HCDA. Buyer further acknowledges and accepts that as a designated reserved housing unit the Unit is subject to certain restrictions and limitations on resale, rental, use and occupancy as more particularly set forth in the Kaka`ako Reserved Housing Rules, the Unit Deed, and the Unilateral Declaration. Buyer further understands and accepts that upon Buyer’s waiver or deemed waiver of the statutory 30-day cancellation right under Section 514B-86 of the Hawaii Revised Statutes that Buyer shall be deemed to have approved and accepted the restrictions and limitations on resale, rental, use and occupancy of the Unit as set forth in the Kaka`ako Reserved Housing Rules, the Unit Deed, and the Unilateral Declaration. VII. Agency Disclosure: BUYER ACKNOWLEDGES AND CONFIRMS THAT IN CONNECTION WITH THE SALE OF THE PROPERTY BY SELLER TO BUYER, PROJECT BROKER AND ALL OF ITS SALES PERSONS AND BROKERS HAVE ACTED AND WILL CONTINUE TO ACT AS AGENT FOR AND SOLELY ON BEHALF OF SELLER, AND DO NOT REPRESENT BUYER. IN THE EVENT THAT BUYER IS REPRESENTED BY A REAL ESTATE BROKER (“BUYER’S BROKER”), BUYER ACKNOWLEDGES AND CONFIRMS THAT BUYER’S BROKER AND ALL OF ITS SALES PERSONS AND BROKERS HAVE ACTED AND WILL CONTINUE TO ACT AS AGENT FOR AND SOLELY ON BEHALF OF BUYER, AND SUCH REPRESENTATION SHALL BE EVIDENCED BY THE SEPARATE COOPERATING BROKER AGREEMENT ATTACHED HERETO AS ADDENDUM CB AND EXECUTED BY AND BETWEEN PROJECT BROKER AND BUYER'S BROKER.   • Work of the Bargaining Unit (a) In order to protect the standard of nursing care, the Employer shall not contract out the work normally performed by members of this bargaining unit except: i) For purposes of instruction, ii) In the event of an emergency situation, iii) When performing developmental or experimental work, or iv) When employees are not available due to an employee not reporting for work as scheduled or not being available for work. (b) Reassignment to other employees of work normally performed by members of the bargaining unit shall not result in the termination, layoff or reduction in hours of any member of the bargaining unit. (c) When it is decided to not fill a position following an employee’s resignation, the Home will provide the rationale in writing for this decision to the Union. The Union may request a meeting to make representations on this matter.
