Resignation and Removal of the Trustee Clause Samples
The 'Resignation and Removal of the Trustee' clause outlines the procedures by which a trustee may voluntarily step down from their role or be removed by other parties involved in the trust. Typically, this clause specifies the notice requirements for resignation, the circumstances under which removal is permitted (such as misconduct or incapacity), and the process for appointing a successor trustee. Its core function is to ensure continuity and proper administration of the trust by providing a clear mechanism for changing trustees when necessary, thereby protecting the interests of the beneficiaries and maintaining trust operations.
