Responsibilities; Duties. 1. The Interim Superintendent agrees to perform faithfully the assigned duties for the Board as described by the laws of the State of New Jersey and the State Board of Education and by the rules, policies and regulations of the Board and in accordance with such statutes or rules, policies and regulations that may become effective during the term of this Contract. 2. In accordance with N.J.S.A. 18A:17-20, the Interim Superintendent shall be the chief executive and administrative officer of the Board and shall have general supervision over all aspects, including the fiscal operations and the instructional programs, of the schools of the Plumsted Township School District under rules and regulations prescribed by the State Board of Education. The Interim Superintendent shall keep informed as to the condition and progress of the foregoing operations and programs and shall report thereon, from time to time, to, and as directed by, the Board. Except as otherwise provided herein, the Interim Superintendent shall have such other powers and perform such other duties as may be prescribed by the Board. 3. The Interim Superintendent shall have a seat on the Board and the right to speak on all matters at meetings or committee meetings of the Board; however, the Interim Superintendent shall have no vote. 4. The specific job description adopted by the Board, and as may be amended by the Board, in consultation with the Interim Superintendent applicable to the position of Superintendent of Schools, is incorporated by reference into this Contract. 5. The Interim Superintendent shall arrange the administrative and supervisory staff of the District including instruction and business affairs, which in the Interim Superintendent's judgment, best serve the District. The Interim Superintendent has responsibility for the selection, renewal, placement, removal and transfer of personnel, subject to approval of the Board, by recorded roll call majority vote of the full membership of the Board after the recommendation of the Interim Superintendent, and subject to applicable Board policies and directives. The Board shall not withhold its approval of any Interim Superintendent recommendation relating to these matters for arbitrary or capricious reasons and shall act in accordance with 6. The members of the Board, individually and collectively, shall refer to the Interim Superintendent all criticisms, complaints and suggestions concerning the operation and management of the District called to their attention. The Board will not take action on any such criticisms, complaints, and/or suggestions until they are discussed by the Board members at a scheduled meeting of the Board and a consensus sought to direct the Interim Superintendent to study, recommend, or take action. 7. Except as otherwise provided herein, the Interim Superintendent shall devote the Interim Superintendent's full time, skills, labor, and attention to this employment during the term of this Contract. The Interim Superintendent may undertake consultative work, speaking engagements, writing, lecturing, or other professional duties for compensation with prior notice to the Board and provided the Interim Superintendent is able to perform all her responsibilities and duties required by this Contract. 8. The Interim Superintendent shall notify the Board President in the event the Interim Superintendent intends to be away from the District on District business for more than one (1) day. Any time away from the District that is not for District business must be arranged in accordance with provisions in this Contract governing Interim Superintendent time off. The Board recognizes that the demands of the Interim Superintendent's position require the Interim Superintendent to work long and irregular hours and the Board recognizes the need for the Interim Superintendent to have some level of flexibility to adjust the Interim Superintendent's office hours. 9. The Interim Superintendent shall attend all regular and special meetings of the Board (except where a Rice notice has been served upon the Interim Superintendent notifying the Interim Superintendent that the Interim Superintendent's employment will be discussed in closed session, and the Interim Superintendent has not requested that the meeting be conducted in public), and all committee meetings of the Board, and shall serve as advisor to the Board and to Board committees on all matters affecting the District. 10. The Interim Superintendent shall have the authority to suggest, from time to time, regulations, rules, policies and procedures deemed necessary for compliance with law and/or for the well being of the District. 11. The Interim Superintendent shall perform all duties incident to the office of the Superintendent and such other duties as may be prescribed by the Board from time to time. The Interim Superintendent shall at all times adhere to all applicable federal and state statutes, rules, regulations, and executive orders, as well as district policies and regulations. 12. The Interim Superintendent shall have the right to legal assistance in carrying out the Interim Superintendent's duties through use of the Board's attorney. The Interim Superintendent shall have the right to make recommendations to the Board or any committee with respect to any proposed action or policy. In the absence of the Interim Superintendent, the Interim Superintendent's designee as contemplated by the District's Table of Organization shall have the authority to make recommendations to the Board. 13. All duties assigned to the Interim Superintendent by the Board shall be appropriate to and consistent with the professional role and responsibility of the Interim Superintendent, and shall be set by Board policy and in the appropriate job description which may be modified from time to time, consistent with the intent of this Contract. 14. Notwithstanding the foregoing, the Board shall have the right to conduct private closed sessions pursuant to the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq., without the attendance of the Interim Superintendent to discuss the Contract negotiations with the Interim Superintendent as well as the Interim Superintendent's performance. In the event the Board intends to take action in public which may be adverse to the Interim Superintendent's employment (adverse public action), the Board shall not hold any discussion regarding the adverse public action unless the Interim Superintendent is given written notice at least forty eight (48) hours in advance and the Interim Superintendent is permitted the opportunity to address the Board in any such closed session held to discuss the adverse public action, provided the Interim Superintendent is available to participate, and is permitted to have a representative of the Interim Superintendent's choosing speak on the Interim Superintendent's behalf. The Board shall not hold any discussions of the Interim Superintendent's performance or that may adversely affect the Interim Superintendent's employment in public session, unless the Interim Superintendent requests that such discussions be held in public pursuant to the Open Public Meetings Act.

The Interim Acting Superintendent shall notify the Board President in the event the Interim Acting Superintendent intends desires to be away from the District district on District business for more than one (1) dayday in any week. Any time away from the District that is not for District business must be arranged by the Acting Superintendent in accordance with the provisions in this Contract governing Interim Acting Superintendent time off. The Board recognizes parties recognize that the demands of the Interim Acting Superintendent's position require devotion to the Interim duties of Acting Superintendent and require the Acting Superintendent to work long and irregular hours and occasionally may require that the Board recognizes Acting Superintendent attend to district business outside of the need for the Interim Superintendent to have some level of flexibility to adjust the Interim Superintendent's office hoursdistrict. 9vii. The Interim Acting Superintendent shall attend all regular and special meetings of the Board (except where a Rice notice has been served upon the Interim Acting Superintendent notifying the Interim Acting Superintendent that the Interim Acting Superintendent's employment will be discussed in closed session, and the Interim Acting Superintendent has not requested that the meeting be conducted in publicpublic or where the Acting Superintendent has a conflict of interest), and all committee meetings of the Board, and shall serve as advisor to the Board and to Board committees on all matters affecting the District. 10viii. The Interim Acting Superintendent shall have the authority to suggest, from time to time, regulations, rules, policies and procedures deemed necessary for compliance with law and/or for the well well-being of the District. 11ix. The Interim Acting Superintendent shall perform all duties incident to the office of the Acting Superintendent and such other duties as may be prescribed by the Board from time to time. The Interim Acting Superintendent shall at all times adhere to all applicable federal and state statutes, rules, regulations, and executive orders, as well as district policies and regulations. 12. x. The Interim Acting Superintendent shall have the right to legal assistance in carrying out the Interim Acting Superintendent's duties through use of the Board's attorney. The Interim Acting Superintendent shall have the right to make recommendations to the Board or any committee with respect to any proposed action or policy. In the absence of the Interim Superintendent, the Interim Superintendent's designee as contemplated by the District's Table of Organization shall have the authority to make recommendations to the Board. 13xi. All duties assigned to the Interim Acting Superintendent by the Board shall be appropriate to and consistent with the professional role and responsibility of the Interim Acting Superintendent, and shall be set by Board policy and in the appropriate job description which may be modified from time to time, consistent with the intent of this Contract. The current job description, which may be amended by the Board from time to time after consultation with the Acting Superintendent, with the ultimate decision on any amendment to be that of the Board, is incorporated by reference into this agreement as if set forth in its entirety. The Board shall not substantially increase the duties of the Acting Superintendent by assigning the Acting Superintendent the duties or responsibilities of another position or title unless the parties agree to an increase in the Acting Superintendent's compensation commensurate with the increase in duties and subject to compliance with any laws or regulations governing Acting Superintendent compensation. 14xii. Notwithstanding the foregoing, the Board shall have the right to conduct private closed sessions pursuant to the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq., without the attendance of the Interim Superintendent to discuss the Contract negotiations with the Interim Superintendent as well as the Interim Superintendent's performance. In the event the Board intends to take action in public which may be adverse to the Interim Superintendent's employment (adverse public action), the Board shall not hold any discussion regarding the adverse public action unless the Interim Superintendent is given written notice at least forty eight (48) hours in advance and the Interim Superintendent is permitted the opportunity to address the Board in any such closed session held to discuss the adverse public action, provided the Interim Superintendent is available to participate, and is permitted to have a representative of the Interim Superintendent's choosing speak on the Interim Superintendent's behalf. Where such conflict exists, this Agreement or state law shall supersede such policy. H. The Committee shall not without the Superintendent's written consent, adopt any policy, by- law or regulation, which impairs or reduces the duties and authority specified above; and provided, further, that all additional duties and responsibilities prescribed by the Committee are consistent with those normally associated with the position of Superintendents of School in the Commonwealth of Massachusetts. The Committee agrees that all members shall be trained in roles and responsibilities as well as district required by MGL, c. 71, sec. 36A. This provision shall continue in full force and effect during any period of employment. I. The position of Superintendent requires full time service over twelve (12) months of the year, less weekends, vacations and holidays. Attendance at night meetings and night events are common features of the work. J. Because the Superintendent's workday frequently begins before and extends beyond normal working hours, time off during the day for personal reasons or business will be allowed without loss of pay or deduction from personal or vacation leave. K. The Superintendent shall fulfill all of the terms and conditions of this contract. The Superintendent shall comply with the policies and regulations. 12. The Interim Superintendent shall have the right to legal assistance in carrying out the Interim Superintendent's duties through use procedures of the Board's attorney. The Interim Superintendent shall have the right to make recommendations to the Board or any committee with respect to any proposed action or policy. The Interim Superintendent shall at all times adhere to all applicable federal and state statutes, rules, regulations, and executive orders, as well as district policies and regulations. 12. The Interim Superintendent shall have the right to legal assistance speak on all issues before the School Committee and have a seat at the Committee table. D. Criticisms, complaints, and suggestions called to the attention of the Committee or individual committee members by any source shall be promptly referred to the "Superintendent" in writing for study, disposition, or recommendation as appropriate to facilitate the orderly administration of the District, ensure responsiveness to the public and fairness to the Superintendent. The Superintendent shall advise the Committee of the disposition of such matters. E. The Committee shall make no agreement with any other employee group or individual that would interfere with the "Superintendent's" carrying out the Interim Superintendent's duties through use of the Board's attorney. The Interim Superintendent shall have the right to make recommendations to the Board statutory, managerial, administrative or any committee with respect to any proposed action or policy. In the absence of the Interim Superintendent, the Interim Superintendent's designee as contemplated by the District's Table of Organization shall have the authority to make recommendations to the Boardsupervisory responsibilities. 13. All duties assigned to the Interim Superintendent by the Board shall be appropriate to and consistent with the professional role and responsibility of the Interim Superintendent, and shall be set by Board policy and in the appropriate job description which may be modified from time to time, consistent with the intent of this Contract. 14. Notwithstanding the foregoing, the Board shall have the right to conduct private closed sessions pursuant to the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq., without the attendance of the Interim Superintendent to discuss the Contract negotiations with the Interim Superintendent as well as the Interim Superintendent's performance. In the event the Board intends to take action in public which may be adverse to the Interim Superintendent's employment (adverse public action), the Board shall not hold any discussion regarding the adverse public action unless the Interim Superintendent is given written notice at least forty eight (48) hours in advance and the Interim Superintendent is permitted the opportunity to address the Board in any such closed session held to discuss the adverse public action, provided the Interim Superintendent is available to participate, and is permitted to have a representative of the Interim Superintendent's choosing speak on the Interim Superintendent's behalf. The Board shall not hold any discussions of the Interim Superintendent's performance or that may adversely affect the Interim Superintendent's employment in public session, unless the Interim Superintendent requests that such discussions be held in public pursuant to the Open Public Meetings Act.
