Common use of RESPONSIBILITIES OF THE SERVICE PROVIDER Clause in Contracts

RESPONSIBILITIES OF THE SERVICE PROVIDER. 12.1 The Service Provider shall provide qualified service personnel to carry out the preventative maintenance tasks listed in Annexure D. 12.2 The Service Provider shall ensure that the service personnel- 12.2.1 Are conversant with the Occupational Health and Safety Act, 1993 (Act No. 85 of 1993) as amended and comply with the relevant sections of the Act; 12.2.2 Are effectively supervised by the Service Provider and that the level of supervision is of a sufficient standard to comply with the preventative maintenance tasks scheduled in Annexure D; and 12.2.3 Are physically and mentally fit to fulfil their duties. 12.3 The Service Provider shall at its own cost ensure that: 12.3.1 The service personnel are properly and appropriately clothed at all times when on duty as prescribed in terms of the Occupational Health and Safety Act; 12.3.2 Its service equipment is maintained and in a fully serviceable condition so as to comply with the legal safety requirements and to enable the service personnel to meet the requirements of the RFP; 12.3.3 Any change room, plant room and facilities made available to the service personnel are kept in a clean and tidy condition; 12.3.4 Appropriate signage and notification pertaining to temporary closure, danger zones, inconvenience or public safety is prominently displayed whenever required; and 12.3.5 The Service Provider shall present, on conclusion of each inspection, maintenance service, supply of diesel or break and fix repair, an acknowledgement of service slip in duplicate for the signature of the SARS Representative. The duplicate copy shall be retained by the SARS Representative for record purposes. 12.4 The Service Provider shall ensure that his personnel comply with the requirements of this Agreement at all times and in all respects. 12.5 The Service Provider is required to provide a level of resource necessary to fulfil his commitments at all times and to take into account sickness and holidays etc. of service personnel. 12.6 The Service Provider shall have sufficient infrastructure on a regional cluster basis for the effective management of this Agreement and the Service Provider shall provide all items/equipment necessary for the proper execution of the Services in terms of this Agreement. 12.7 The Service Provider shall set up a Service Centre, to which Service Calls will be logged, prior to the Commencement Date.

The approved listing of qualified service personnel and or subcontractors are attached as Annexure E. Any substitutions or variations to this list of approved service personnel may be approved by USP after submission and endorsement by USP of the CVs and or subcontractor details of proposed substitutes. The Service Provider shall ensure that the service personnel- 12.2.1 personnel- Are conversant with the Occupational Health and Safety Act, 1993 (Act No. 85 Laws of 1993) as amended and comply with the relevant sections of the Act; 12.2.2 Fiji; Are effectively supervised by the Service Provider and that the level of supervision is of a sufficient standard to comply with the preventative maintenance tasks scheduled in Annexure D; and 12.2.3 and Are physically and mentally fit to fulfil fulfill their duties. 12.3 .
