Common use of Restoration of the Project Clause in Contracts

Restoration of the Project. Owner shall provide as much advance notice as reasonably practicable to CECONY of the date and time the Project will be back online, in part or in its entirety, provided that Owner shall provide at least two (2) days’ prior notice for restoration from a Planned Outage and at least two (2) hours’ notice for restoration from an Unplanned Outage. CECONY shall be entitled to rely on such notice for purposes of bidding Products into real-time wholesale electric markets. For purposes of calculating the availability of the Project, the Project shall only be considered available, and only to the extent the Project is available, in the first full hour in which the Project could have been bid into real-time wholesale electric markets.
