Restriction on Bundling Clause Samples

A Restriction on Bundling clause prohibits one party from combining the products or services covered by the agreement with other unrelated products or services when offering them to customers. In practice, this means the seller cannot require buyers to purchase additional items as a condition for obtaining the contracted goods or services, nor can they package the contracted items with others in a way that limits buyer choice. Restriction on Bundling. If a Party or its Affiliates or Sublicensees sell Licensed Product to a Third Party who also purchases other products or services from such Party or its Affiliates, such Party shall not, and shall require its Affiliates and Sublicensees not to, (i) bundle or include any Licensed Product as part of any incentive programs, chargebacks, disease management programs or similar programs based on multiple product offerings or (ii) discount or price the Licensed Product, in the case of either of the foregoing clauses (i) or (ii), such that the applicable rebate, discount, other form of reimbursement for, or the price of, the Licensed Product in such arrangement is inconsistent with the rebate, discount, or other form of reimbursement for, or price of, the Licensed Product when sold separately to such Person from any such other products or services sold to such Person.
Restriction on Bundling. [***] To protect Nintendo’s valuable Intellectual Property Rights, to prevent the dilution of Nintendo’s trademarks and to preclude free-riding by non-licensed products on the goodwill associated with Nintendo’s trademarks, LICENSEE shall not market or distribute any Games or Game Discs that have been bundled with any peripheral designed for use with Wii that has not been licensed or approved in writing by NOA.
Restriction on Bundling. Reseller agrees not to Bundle the Rogers Services with a product or service that is: (a) the same or similar to any wireless communications product or service that is offered by Rogers; (b) a broadcast distribution product or service including, without limitation, direct to home satellite service, multi-channel, multi-point distribution service, or any other cable distribution service; or (c) a high speed internet access service.
