Common use of Restrictions and Regulations Clause in Contracts

Restrictions and Regulations. 1. All the Operator’s operations and activities under this Agreement will be subject to: a. Any order, direction, or condition issued, given, or imposed by the Airport Director with respect to use of Airport roadways, driveways, curbs, sidewalks, or parking areas, and public areas adjacent to Parking Facilities; and b. Any applicable ordinance, statute, rule, regulation, or order of any governmental authority lawfully exercising authority over the COMMISSION’s or Operator’s business or other activities under this Agreement. 2. The COMMISSION will not be liable to the Operator for any diminishing or deprivation of its rights under this Agreement due to the exercise of any such authority as provided above, nor will Operator be entitled to terminate the whole or any portion of this Agreement by reason thereof unless the exercise of such authority will so interfere with Operator's operation of the Parking Facilities in the exercise of its right under this Agreement as to constitute a termination in whole or in part of this Agreement by operation of law in accordance with the laws of the State of Michigan.
