Common use of Resumption of Performance Clause in Contracts

Resumption of Performance. When the Nonperforming Party is able to (a) resume performance of its obligations under this Agreement or (b) satisfy the conditions precedent to the Performing Party’s obligations, it shall immediately give the Performing Party written notice to that effect and shall resume performance under this Agreement no later than two working days after the notice is delivered.
