Retention of Architect and Approval of Tenant’s Space Plan. Landlord shall retain the Architect to prepare the plans and specifications for the Improvements. Tenant shall deliver Tenant’s Space Plan, approved by Tenant, within the time permitted by the Construction and Design Schedule. Landlord shall approve or disapprove Tenant’s Space Plan within the time permitted by the Construction and Design Schedule. Tenant’s delivery of Tenant’s Space Plan to Landlord shall be deemed and acknowledgement and agreement by Tenant, (a) that Tenant’s Space Plan accurately represents Tenant’s plans for the Premises, (b) that budget estimates will be based on Tenant’s Space Plan, (c) that Landlord will prepare Construction Documents based upon Tenant’s Space Plan, and (d) THAT ANY MODIFICATION OF TENANT’S SPACE PLAN AFTER THE DATE OF LANDLORD’S APPROVAL AND PREPARATION OF BUDGET ESTIMATES MAY INCREASE THE COST OF THE LEASEHOLD IMPROVEMENTS.
