Common use of Return of PHI Clause in Contracts

Return of PHI. Business Associate agrees that upon termination of this Agreement, and if feasible, Business Associate shall (a) return or destroy all PHI received from, or created or received by Business Associate on behalf of, Covered Entity that Business Associate still maintains in any form and retain no copies of such information or, (b) if such return or destruction is not feasible, extend the protection of this Agreement to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI infeasible.

Return of PHI. Business Associate agrees that that, upon termination of this Agreement, and if feasiblecommercially reasonable, Business Associate shall (a) return or destroy all PHI received from, or created or received by Business Associate on behalf of, Covered Entity that Business Associate still maintains in any form and retain no copies of such information or, (b) if such return or destruction is not feasiblecommercially reasonable, extend the protection of this Agreement to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI infeasiblenot commercially reasonable.

Business Associate agrees that upon termination At the end of the term of this Agreement, and if feasibleAddendum, Business Associate shall (a) return or destroy all PHI received from, or created or received by Business Associate on behalf of, Covered Entity Provider that Business Associate still maintains in any form and retain no copies of such information orinformation; provided that, (b) if and to the extent Business Associate reasonably determines that such return or destruction is not reasonably feasible, Business Associate shall not be required to return or destroy such PHI, but Business Associate shall extend the protection protections of this Agreement Addendum to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI infeasiblePHI.

Business Associate agrees that upon termination of this Agreement, and if feasible, Business Associate shall (a) return or destroy all PHI received fromfrom Covered Entity, or created or received by Business Associate on behalf ofof Covered Entity, Covered Entity that Business Associate still maintains in any form or manner and retain no copies of such information or, (b) if such return or destruction is not feasible, immediately notify Covered Entity of the reasons return or destruction are not feasible, and extend indefinitely the protection of this Agreement to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI infeasiblenot feasible.
