Common use of Return of Security Clause in Contracts

Return of Security. Aurizon Network must return to the End User (and, where appropriate, give the End User any necessary releases in relation to) any Security provided by the End User under this clause 6: (a) subject to Aurizon Network’s rights of recourse to the Security under clause 6.6, promptly after the date of termination or expiry of this Agreement; (b) on the End User delivering to Aurizon Network any replacement Security under clause 6.3(b)(iv), 6.4(e) or 6.5 which satisfies the requirements of this clause 6; or (c) if, after a review pursuant to clause 6.7, Aurizon Network considers, acting reasonably, that it is no longer necessary for the End User to provide Aurizon Network with Security under this clause 6.
