Common use of Return to Position Clause in Contracts

Return to Position. At the expiration of the leave of absence the employee shall, unless he/she otherwise agrees, be reinstated in the position held by him/her at the time of the granting of the sabbatical leave or in a position within the scope of his/her certification.

Return to Position. At the expiration of a sabbatical leave, the certificated employee who has been granted such leave of absence the employee shallshall be reinstated, unless he/she otherwise agreesagrees otherwise, be reinstated in the position held by him/her at the time the leave was granted, provided that the conditions have not arisen which would have changed such employee's location and type of work had he/she remained in active service.
