Common use of Return to Position Clause in Contracts

Return to Position. Any employee returning from leave shall be returned to the work group and position held prior to taking such leave provided: (1) The position still exists; and (2) No employee in the classified service has been assigned to such position for a period exceeding one (1) year. (3) No employee returning from leave shall have greater right to a position than they would have had if they had not gone on leave.
