Return to Work When Employee Terminates Employment. Where an employee has terminated their employment due to pregnancy or childbirth, but the child does not live, they will be entitled to return to work but without the right to return to the same post at the same grade and salary as applied immediately prior to the termination of employment unless the council determines that this is not practicable. However, an employee will not be entitled to return to employment with the council in accordance with this paragraph unless:- - a suitable vacancy exists; and - they submit in writing a doctor’s statement that they are medically fit to return, if such a statement is required by the council; and - they satisfy the requirements of sub-clauses 11.6 (a) - (c) above in respect of the timing of their return to work.
