Common use of Returning from Leave of Absence Clause in Contracts

Returning from Leave of Absence. 32 The returning employee will not necessarily be assigned to the identical position occupied before the 33 leave of absence. However, provided a vacancy exists for which the employee is qualified, the 34 employee shall be reinstated to a position equivalent in duties and salary to that held at the time the 35 request for leave of absence was approved. The employee on leave must notify the District no later 36 than April 1st of their intentions for the following school year. Failure to respond by April 1st will 37 result in separation of employment. 39 If a vacancy does not exist equivalent in duties and salary, a layoff consistent with other provisions of 40 this Agreement will be instituted to create an appropriate position. 41
