Common use of Returning from Leave of Absence Clause in Contracts

Returning from Leave of Absence. An employee who has been on an extended leave of absence, will, if he has given the thirty (30) days notice of return, have the right to any vacancy available in the curricular or subject area for which said employee is qualified and certified and endorsed as to grade level and approved as to subject matter. If there is no such vacancy, then seniority permitting the District will lay off, effective for the following school year, the least senior employee in a position for which the returning employee is certified, endorsed and approved.
