Revenue Defined. For purposes of the above vesting schedule, the term “Revenue” shall mean the Company’s total revenue for the applicable fiscal year.

Revenue shall be determined on an accrual basis in accordance with generally accepted accounting principles consistently applied.
Revenue Defined. The term “Revenue” includes all fees, minimum royalties, payments, compensation, or consideration of any kind, including without limitation in-kind payments, forbearance in connection with settlement, equity amounts taken in lieu of cash, or discounts below fair market value of equity received by either Party or its Affiliates as a result of any Enforcement Action, without regard to which entity pays, transfers or otherwise provides the Revenue, or how the Revenue is structured, denominated, or paid transferred or provided.
Revenue Defined. The “Revenue” of the Company for any period means the gross sales price of all merchandise, gifl or merchandise certificates, or services sold by the Company during the period, using the same method of accounting used for Federal income tax purposes, reduced by (i) the sales price of all merchandise returned by customers and accepted for full credit or the amount of discounts and allowances made on such merchandise to the extent previously included in revenue; (ii) the amount of any sales taxes, so-called luxury taxes, consumers’ excise taxes, gross receipts taxes, and other similar taxes imposed upon the sale of merchandise or services, but only if collected separately from the selling price of merchandise or services and collected from customers and paid to the taxing authority; (iii) the amount of any sales of fixtures, equipment, or other property which are not stock in trade of the Company; (iv) the amount of any sales of gifl or merchandise certificates until converted to a sale by redemption for actual merchandise or services; (v) any cash or credit discount, allowance, or refund made upon any sales; and (vi) tips or gratuities paid by customers to or for the benefit of the Company’s employees which are retained by the Company’s employees, which is earned solely through the Companies operations conducted at ▇▇▇▇ ▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇▇▇▇ ▇▇, ▇▇▇▇▇.   • FTE Definition Part-time teacher FTE will be determined by the ratio of the teacher’s actual assignable time to the teacher assignable time of a full-time assignment in the teacher’s school. This FTE will be used to calculate the maximum prorated portion of a teacher’s instructional time.

  • – SCOPE & DEFINITIONS 2.01 The Employer recognizes the Union as the bargaining agent for all Registered and Graduate nurses employed by Foyer des Pionniers, at Hearst, Ontario, engaged in a nursing capacity, save and except the Director of Nursing and persons above the rank of Director of Nursing. Where the singular is used, it may also be deemed to mean the plural and vice-versa.

  • Overtime Defined All time worked before or after the regular work day, the regular work week or on a holiday, as specified herein, shall be considered overtime.

  • Overtime Definition Overtime shall be defined as being all hours worked in excess of the normal or standard work day, or in excess of the normal or standard work week. The overtime rate shall be one and one-half (1½) times the regular straight time hourly rate of pay. NOTE: Article 16.04 is applicable to full-time employees only.

  • EMPLOYEE DEFINED As used in this Section, "employee" means any person holding a regular, provisional, or temporary appointment in the County service, and otherwise subject to the provisions of this Memorandum of Understanding.
