Common use of Revocation or Withdrawal of Plan Clause in Contracts

Revocation or Withdrawal of Plan. The Debtors reserve the right, subject to the prior written consent of the Plan Sponsor, to revoke or withdraw the Plan prior to the Effective Date as to any or all of the Debtors. If, with respect to a Debtor, the Plan has been revoked or withdrawn prior to the Effective Date, or if confirmation or the occurrence of the Effective Date as to such Debtor does not occur on the Effective Date, then, with respect to such Debtor: (a) the Plan shall be null and void in all respects; (b) any settlement or compromise embodied in the Plan (including the fixing of or limiting of an amount of any Claim or Interest or Class of Claims or Interests), assumption of Executory Contracts or Unexpired Leases affected by the Plan, and any document or agreement executed pursuant to the Plan shall be deemed null and void; and (c) nothing contained in the Plan shall (i) constitute a waiver or release of any Claim by or against, or any Interest in, such Debtor or any other Entity, (ii) prejudice in any manner the rights of such Debtor or any other Entity, or (iii) constitute an admission of any sort by any Debtor or the Plan Sponsor, or any other Entity.

The Subject to the terms of the RSA, the Debtors reserve the right, subject to the prior written consent of the Plan Sponsor, right to revoke or withdraw the this Plan prior to the Effective Date as to any or all of the Debtors. If, with respect to a Debtor, the this Plan has been revoked or withdrawn prior to the Effective Date, or if confirmation or the occurrence of the Effective Date as to such Debtor does not occur on the Effective Date, then, with respect to such Debtor: Debtor (ai) the this Plan shall be null and void in all respects; , (bii) any settlement or compromise embodied in the this Plan (including the fixing of or limiting of to an amount of any Claim or Interest or Class of Claims or Interests), assumption or rejection of Executory Contracts executory contracts or Unexpired Leases unexpired leases affected by the this Plan, and any document or agreement executed pursuant to the this Plan shall be deemed null and void; , and (ciii) nothing contained in the this Plan shall (ia) constitute a waiver or release of any Claim by or against, or any Interest in, such Debtor or any other EntityPerson, (iib) prejudice in any manner the rights of such Debtor or any other EntityPerson, or (iiic) constitute an admission of any sort by any Debtor or the Plan Sponsor, or any other EntityPerson.
